BAKHABAR KISSAN (PVT.) LIMITED

These Terms and Conditions of Use (the "Terms" or "Agreement") govern your access to and use of all user-generated content, websites, mobile applications, SMS services, digital platforms, social media accounts, pages, and related services (collectively, the "Platforms") that belong to, or are managed by, BAKHABAR KISSAN (PVT.) LIMITED, a company incorporated under the laws of the Islamic Republic of Pakistan ("BaKhabar Kissan," "Company," "we," "our," or "us").

By accessing, browsing, subscribing to, or using our Platforms, you agree to be bound by these Terms, all applicable laws and regulations, and any other policies, guidelines, or agreements referenced herein. If you do not agree to these Terms or are unable to form a legally binding contract, you must not use our Platforms.

1. Access Requirements

To access the BaKhabar Kissan Digital Platform (BKK Service), you must:

• Have a compatible mobile device, smartphone, computer, or other supported device.
• Maintain an active mobile data connection or internet access.
• Maintain an active SIM connection (where applicable).
• Hold a valid and active subscription.

Standard data charges may apply in accordance with your mobile network operator's tariff plan.

2. Subscription, Packages & Charges

2.1 Subscription Services

Subscribed users will receive full access to the content and services offered under the BKK Service, which may include but are not limited to:

• Agricultural advisory content
• Crop updates and farming tips
• Weather forecasts
• Market price updates
• SMS alerts and notifications
• Expert guidance content
• Educational and informational multimedia content

Access is granted during the validity period of the selected subscription package.

2.2 Subscription Charges

Subscription charges include:

• Platform access charges
• Telco access charges
• Charges for confirmations, alerts, notifications, and updates
• Applicable federal, provincial, and regulatory taxes

Effective January 01, 2025, the BKK Service is offered on a Daily Subscription Plan, and the applicable charges are as follows:

Jazz:

• Jazz Prepaid: PKR 5 (inclusive of all applicable taxes) per day
• Jazz Postpaid: PKR 60 (inclusive of all applicable taxes) per month

Ufone:

• Ufone Prepaid: PKR 5 (inclusive of all applicable taxes) per day
• Ufone Postpaid: PKR 5 (inclusive of all applicable taxes) per day

Zong:

• Zong Prepaid: PKR 5 (exclusive of applicable taxes) per day

For Zong prepaid subscribers, applicable taxes shall be charged in addition to the base subscription amount of PKR 5 per day, as per prevailing tax regulations.

Charges shall be deducted daily from the subscriber's mobile balance (for prepaid users) or included in the monthly bill (for postpaid users), subject to sufficient balance availability and operator policies.

The above-mentioned access charges (telco cost) are applicable to all digital products offered by BaKhabar Kissan (Pvt.) Limited.

2.3 Auto-Renewal

Unless unsubscribed by the user, subscriptions shall automatically renew upon expiry of the applicable validity period. Relevant subscription charges shall be deducted from the user's prepaid balance or billed accordingly, subject to sufficient balance availability.

Users may unsubscribe at any time through the prescribed opt-out mechanism communicated at the time of subscription.

2.4 Changes in Charges

BaKhabar Kissan reserves the right to revise subscription charges, features, or package structures at any time in compliance with applicable laws and regulatory requirements. Any such changes shall become effective upon publication on the Platform or through other official communication channels.

3. Use Limitations & Guidelines

You agree to comply with all applicable laws and with the following guidelines when using our Platforms:

• Stay relevant and on topic.
• Maintain respectful and appropriate conduct.
• Do not post defamatory, obscene, unlawful, misleading, or offensive content.
• Do not use the Platforms for commercial purposes without prior written consent.
• Do not upload harmful code including viruses, Trojan horses, worms, or malware.
• Do not infringe upon intellectual property or privacy rights of any third party.
• Do not attempt unauthorized access to administrative areas or systems.

We reserve the right to moderate, restrict, or remove any content or user access at our sole discretion.

By posting content, you grant BaKhabar Kissan an irrevocable, worldwide, royalty-free license to use, reproduce, distribute, modify, publish, and display such content in any media format.

4. Privacy

Your use of the Platforms is subject to our Privacy Policy and any applicable third-party platform policies.

BaKhabar Kissan will never request passwords, PINs, or sensitive financial information via social media or email. Users are advised not to disclose personal or financial information publicly.

You acknowledge that internet transmissions are not fully secure and that you assume all risks associated with transmitting information online.

5. Monitoring & Disclosure

BaKhabar Kissan reserves the right (but has no obligation) to monitor usage of the Platforms. We may examine, record, copy, or use information transmitted through the Platforms for operational, regulatory, or security purposes.

We may disclose information as required by law, regulation, or governmental request.

6. Intellectual Property Rights

All content on the Platforms is owned by or licensed to BaKhabar Kissan and is protected under applicable intellectual property laws.

Users may download or view content for personal, non-commercial use only. You may not:

• Modify or reproduce content without permission
• Use content for commercial purposes
• Remove copyright or proprietary notices
• Mirror content on another server.

Violation of these terms may result in termination of access.

7. Disclaimers

All materials are provided "as is" without warranties of any kind, express or implied.

BaKhabar Kissan does not warrant:

• That the Platforms will be uninterrupted or error-free
• That defects will be corrected
• That content is free from inaccuracies or viruses

Content provided is for informational purposes only and does not constitute legal, financial, investment, or professional advice.

8. Limitation of Liability

Use of the Platforms is entirely at your own risk.

In no event shall BaKhabar Kissan, its affiliates, employees, agents, or suppliers be liable for any direct, indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of data, profits, or business interruption arising from use of or inability to use the Platforms.

Your sole remedy for dissatisfaction is to discontinue use of the Platforms.

9. Indemnification

You agree to indemnify and hold harmless BaKhabar Kissan, its directors, employees, agents, and affiliates from any claims, liabilities, damages, or expenses arising out of your use of the Platforms or violation of these Terms.

10. Third-Party Links

The Platforms may contain links to third-party websites. BaKhabar Kissan is not responsible for the content, policies, or practices of such third-party sites.

Use of third-party websites is at your own risk.

11. Modification or Termination

BaKhabar Kissan reserves the right to modify, suspend, or discontinue any part of the Platforms at any time without prior notice.

We may revise these Terms at any time. Continued use of the Platforms constitutes acceptance of the updated Terms.

12. Relationship

Nothing in these Terms creates any agency, partnership, employment, fiduciary, or joint venture relationship between you and BaKhabar Kissan.

13. Termination of Use

BaKhabar Kissan may terminate or suspend your access to the Platforms at its sole discretion without notice.

14. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.

The courts of Pakistan shall have exclusive jurisdiction over any disputes arising from or related to these Terms.

Any claim against BaKhabar Kissan must be filed within one (1) year from the date the cause of action arose.

15. Severability

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

16. Entire Agreement

These Terms constitute the entire agreement between you and BaKhabar Kissan regarding use of the Platforms and supersede all prior communications or agreements relating to the subject matter herein.
